On this issue, NYSACRA continues to have grave concerns about the ability of DOH and consequently vendors and providers, to be ready to bill o­n October 16, the deadline to have HIPAA compliant transactions.  NYSACRA, with a coalition of other associations, has met with the Governor’s office, are developing a letter to Senators Clinton and Schumer, and are planning meetings with the NYS Department of Health and the Division of Budget.

Additional information from DOH available recently around this issue is as follows:

1.   The beginning of o­n-line "Open Provider Testing" via EDIFCS has been delayed—DOH said this o­n-line testing is now expected to be available to providers and vendors beginning o­n Friday, July 18, 2003.  EDIFCS testing should enable providers to catch the majority of errors in billing submissions, but this testing is not a guarantee that a particular claim will be successfully processed and that payment will be made.

2.   Previously, the Dept. of Health (DOH) and Computer Science Corporation (CSC) have said that, to be able to test via EDIFCS, a provider had to sign and return a trading partner agreement to DOH/CSC.  However, because o­nly about 20% of trading partner agreements have been returned thus far, DOH and CSC are now saying that a signed trading partner agreement is NOT required to test with EDIFCS.

DOH is stating that signed trading partner agreements WILL BE REQUIRED to submit claims when the HIPAA-compliant transaction system "goes live" o­n September 27, 2003.  DOH is saying consequently, that it is still important to sign and return a trading partner agreement to DOH/CSC.  DOH/CSC will be sending out a letter reminding vendors and providers to submit trading partner agreements.

A number of our members and their attorneys do not feel that they should sign the agreement with the "no claims, no damages" language that DOH put in there, and that it is unclear whether it is required by HIPAA.  We recommend that your attorney review this agreement carefully before signing it.

3.   Complete "end-to-end" testing for a select group of providers is still scheduled to begin in August.  DOH said this group has been increased in size from 14 to 20 members, but hasn’t identified who were added to the group.  In addition, there are reports from the field that some vendors are notifying clients about increased fees for HIPAA-compliant software--but with no guarantee from these vendors that use of the software will result in payment of claims.

4.   CSC is sending out another letter to providers and vendors about another round of regional training sessions, similar to the o­nes held in April and May.  These new sessions will be held during August.  The training sessions will be held in: Manhattan, Rochester, White Plains, Suffern, Rensselaer, Syracuse, Hauppauge, Buffalo, and Watertown and we will get you further information when we have it.

5.   Recognizing that there may be transmission problems in getting claims data to CSC beginning September 27, 2003, CSC will double the number of available phone lines.
