UPDATE on PROPOSED REGS - ARTICLE 28 P/T CLINICS

As you know, the NYS Department of Health (DOH) has proposed new regulations that will effectively close all part-time Article 28 clinics (even those not in group homes) that provide rehabilitation services to people with mental retardation and developmental disabilities.  Click Here for a PDF version of the five page joint letter of opposition to SHRPC on this, signed by the provider associations in New York State. Thank you to those members that provided letters as well.  This serious and significant change is a step towards closing Article 28 clinics entirely that serve people with MR/DD.  NYSACRA learned from the CP Association of NYS that the State Hospital Review and Planning Council (SHRPC) Codes Committee met on September 23, 2004 and postponed a vote until their next meeting.  It is extremely important that advocates, families and agencies actively oppose this new regulation and become educated about the access and quality issues that will result from its implementation.  Write to the Governor, Legislators, DOH Commissioner and cc NYSACRA.  You may want to bring your concerns to Commissioner Maul, as well, who remains silent on this issue.  Send additional comments to William Johnson, DOH, Division of Legal Affairs, Office of Regulatory Reform, Corning Tower, Rm. 2415, Empire State Plaza, Albany, NY 12237; or fax to 518-486-4834 or email to This e-mail address is being protected from spam bots, you need JavaScript enabled to view it .

MEDICAID HIPAA COMPLIANCE DEADLINE – 10/6/04
EXCEPTIONS WILL BE ALLOWED

As everyone knows, NYS Department of Health (NYS DOH) has established October 6, 2004 as the HIPAA compliance deadline for submitting electronic claims and other electronic transactions in a HIPAA compliant format.  NYSACRA has received a notice that providers will be granted exceptions and will have until December 29, 2004 to complete testing and to bring transactions into HIPAA compliance.  An application must be submitted for this extension and will be available with a notice next week. 

REMINDER - NYSACRA FAX MACHINE DOWN – 9/21 TO 9/23
