STATE BUDGET POISED FOR ON-TIME PASSAGE; INCLUDES COUNTY MEDICAID RELIEF
The NYS Senate and Assembly have both passed and concluded final negotiations through Conference Committees of their version of the Governor’s budget. The budget bills are being drafted now and if completed by today will be live for passage by April 1st. The Legislature’s budget adds an additional $1.55 Billion to the Governor’s Executive Budget proposal. The Mental Hygiene Budget Conference Committee only received an additional $12 Million to divide among all three agencies; OMH, OASAS, and OMR, probably in that order.
On Friday, both houses agreed to a deal that would cap the county Medicaid share at 2005 levels but requiring only moderate fixed increases. The proposal would increase county costs by 3.5 percent in 2006, 3.25 percent in 2007 and 3 percent annually after that. Counties could choose instead to give the State a specified part of their sales tax revenues, whichever is cheaper. The entire Budget being printed by the Legislature is still subject to the Governor’s veto and he has indicated that he intends to use that power. This Medicaid cap, Governor Pataki said, “can't happen unless we have real Medicaid reform and cost containment."

They will share the story of how Plaintiffs George Lane and Beverly Jones filed a lawsuit alleging that the State of Tennessee and twenty-five Tennessee counties were in violation of Title II of the ADA by failing to ensure that the State’s judicial program is accessible to individuals with disabilities. We are pleased to let our members know that in addition to reaching settlement with the State of Tennessee, the Plaintiffs have reached settlement of all of their injunctive relief claims against the twenty-five County Defendants.
