The U.S. Congressional Bill, Children's Health and Medicare Protection (CHAMP), H.R.3162, (the House's version of SCHIP reauthorization) includes bill Section 814 in the conference report on SCHIP. Congress must include the language in Section 814 that imposes a one-year moratorium to prohibit HHS from taking any action to restrict coverage or payment for rehabilitation services or school-based administration if such restrictions are more restrictive than those applied as of July 1, 2007.

· Include Bill Sections 803 and 814 of the House- passed SCHIP bill to protect adult day services and place a one- year moratorium on restricted Medicaid coverage/payment for rehabilitation services.
· Name Senate conferees this week to meet with House conferees to iron out differences between Senate and House versions of SCHIP.
· Push ahead with SCHIP coverage that covers as many uninsured children as possible.
· Pass SCHIP legislation before September 30th!

Protect State Flexibility, Innovative &
Less Costly Medicaid Services Under the Rehabilitation Option
In the past, adult day services for people with mental retardation and other developmental disabilities were covered under their Medicaid's state plan rehabilitation option. Section 803 of the House- passed SCHIP bill would prohibit HHS from disallowing or denying matching Medicaid payments to states for providing adult day services under their state plan that was approved during or before 1994. Section 814 of the same bill imposes a one-year moratorium that would prohibit HHS from taking any action (promulgation of regulation, issuance of regulatory guidance, audit procedures, or other administrative action, policy or practice) to restrict coverage or payment for rehabilitation services or school-based administration if such restrictions are more restrictive than those applied as of July 1, 2007.

Thanks to your efforts on our last Action Alert on an amendment to H.R. 811 that would have rolled HAVA implementation back to 2010, people with disabilities should now be able to vote on accessible machines in 2008! Keep up the good work!!
