COMMENTS ON PROPOSED REHAB REGULATIONS DUE FRIDAY!!
Friday October 12, 2007 at 5:00p.m. is the deadline for comments to be submitted to CNS on their proposed regulations amending coverage for Rehabilitation services. NYSACRA and its sister associations across New York and nationally have prepared written comments to submit CMS. All Agency providers should prepare their own testimony or use those prepared by NYSACRA or one of the other associations. The important thing is to submit comments electronically by the deadline since CMS will be counting the number of submissions.

SUMMARY OF PROPOSED REHAB REGULATIONS
In the August 13, 2007, Federal Register, from page 45201 to page 45213, CMS published a Notice of Proposed Rulemaking (NPRM) amending 42 CFR Part 440.130 (d) and adding a new section 441.45, in relation to Coverage for Rehabilitation Services. (See NYSACRA website or email version for copies of all documents referenced in this ALERT.)
The new rules would at the least:
· Directly affect the provision of rehabilitation and habilitation services, such as those provided in day treatment, Article 16 and Article 28 clinics.
· Exclude habilitation services from Medicaid reimbursement under this section.
· Define such services to be reimbursable only if would result in the reduction of the individual’s physical or mental disability and restoration to the best possible functional level of the individual. Non covered services would include vocational, pre- vocational, etc.
· Require that all services would have to be included in the Rehabilitation Plan for the individual.
