Background
The Centers for Medicare and Medicaid Services (CMS) has issued a number of Medicaid Regulations recently that will reduce federal Medicaid payments to every state. CMS projects $16 billion in reduced federal funding over five years with implementation of these selected regulations; the Congressional Budget Office (CBO) estimates the figure is more likely to be $20 billion; and 43 State Medicaid Directors reported $50 billion in lost federal payments over five years.
Impact on Medicaid Services
Whether the combined fiscal impact of implementing these CMS regulations is $20 billion or $50 billion, or somewhere in between, New York State alone could lose as much as $10 Billion in federal Medicaid payments over the next five years.
These regulations will result in an unprecedented loss in federal funding, shifting the burden of billions of dollars to the state and local governments, with providers and beneficiaries eventually sharing in that burden. The loss of federal Medicaid funding comes at a time when our state is dealing with drastically reduced revenues due to the economic slowdown. The size of the federal funding withdrawal would be impossible for New York State to absorb and would restrict the reach and effectiveness of the Medicaid program.
Fortunately, Congress has the authority to delay the implementation of regulations through a legally authorized postponement known as a moratorium that provides Congress with time to review the regulations closely and propose needed revisions.
Passage of S. 2819 and H.R. 5613 will depend greatly on
how many people contact their Representatives.
