· CMS MEDICAID MORATORIUM PASSED IN WAR SPENDING BILL BY SENATE
|

The U.S. Senate passed and then sent a supplemental war-spending bill (H.R. 2642) back to the House with more than $165 billion in war spending, expanded veterans education benefits and a host of domestic spending, including the CMS Regs Moratorium. The vote was sufficient to override any Presidential veto, by a margin of 75-22. House lawmakers will take up the bill when they return in two weeks. THE U.S. House and U.S. Senate are in recess for the holiday and will reconvene for legislative business on June 2, 2008. |

· ASSEMBLY HEALTH COMMITTEE TO REVIEW DME AGAIN
|

Assemblyman Richard Gottfried, Chairman of the State Assembly's Health Committee will reopen an investigation into the troubled Durable Medical Equipment (DME) Medicaid program. The Assembly Health Committee issued a scathing 47-page report on the state's office of durable medical equipment in July 2006. Gottfried said the Health Department has made progress in processing claims, but clearly not enough. Please let NYSACRA know if your Agency is still having issues with the DME approvals process. |

· CQC COMMISSIONER MOVING ON

It was announced this week that CQC Commissioner Gary O'Brien has resigned his post. While providers did not always agree with CQC, we believe that Mr. O'Brien was a fair and balanced advocate for individuals with disabilities in New York State, and we thank him for his dedication to the CQC mission. We wish him well in his future endeavors. |

· U.S. REP VITO FOSSELLA WON'T SEEK REELECTION
|

Rep. Vito J. Fossella (R-N.Y.) will not seek reelection in November after admitting to an extramarital affair with a former Air Force official, which came after a drunken-driving arrest in Alexandria three weeks ago. Fossella is not resigning immediately, saving House Republicans from having to defend another seat in what would have been an expensive special election had he left Congress altogether. The party has lost three seats through such elections since March. Fossella, 43, is married and has three children living in Staten Island. He also has a 3-year-old daughter with Laura Fay, the former Air Force official, living near Washington D.C., it's not yet clear who will run for the seat. |
