Congress took a major step toward completing work on the emergency spending package (H.R. 2642) by approving a compromise spending bill that funds Iraq and Afghanistan wars and additional domestic spending. The amendment regarding domestic spending was approved on a 416-12 vote, and includes a moratorium on six of the seven CMS regulations, a 13-week extension of unemployment insurance benefits, and expansion of GI education benefits. In addition, the bill still includes $5 million for a study to determine the prevalence of fraud, abuse, and waste in the Medicaid program and $25 million for the purpose of reducing fraud and abuse. The bill now goes to the U.S. Senate, where it may pass by Friday before the July Recess. The President is expected to sign the bill when it reaches his desk.

The New York State Medicaid Update for June, 2008 is now available on the NYS DOH website and contains important information about National Provider Identifiers (NPIs) for clinicians. There are two separate articles related to the topic; first, DOH is planning to implement the NPI requirement on September 1, 2008; second, the requirement will be that providers' NPIs are linked with the NPI of the clinic or facility, so providers need to keep accurate, current rosters. The article provides links to websites for help with rosters and NPI reporting information.

| · CLINIC PROVIDERS TAKE NOTE

OMR's videoconference on June 19, 2008 provided key information about changes in clinic certification and payment methods for both article 16 and article 28 clinics. Providers were assigned to categories of certification based on the amount of acute and long-term services they deliver; for example, 5 clinics will convert totally from 28s to 16s, while 27 clinics will have joint licensure; one clinic will convert from a 16 to a 28, and 43 clinics will retain their existing single licensure. Payment methods will also change, with a new "APG" (Ambulatory Patient Group) applied to article 28 clinics in April, 2009; it will pay more for higher intensity services and will permit payment for multiple services provided on the same day. The APG method will be applied to article 16 clinics in 2009 or 2010, but in the meantime, there will be an increase in article 16 fees (no dollar figures available yet). The Department of Health is conducting training on the new payment system now for hospitals, with a plan to train clinic providers in the fall. See www.nysacra.org for info.

| · MEDICARE ENROLLMENT PROJECT

Late last month, OMR notified Executive Directors of a statewide initiative to pursue Social Security and Medicare enrollment for individuals served by voluntary agencies. The Social Security Administration has agreed to partner with OMRDD in this initiative. After piloting the approach earlier this year with three voluntary agencies, OMR has asked for agencies to appoint a liaison to work directly on the project, and to establish a Secure Message Center account so that confidential information can be exchanged. The project will require residential providers to contact parents of those 22 years and older, and collect certain information that will help screen for potential eligibility for Social Security benefits for the person with a disability. Similar to the Medicaid and Waiver enrollment project, NYSACRA and other associations will serve as a liaison for their member agencies and OMR.
