· FOOD STAMPS BRIEF SURVEY

The provider associations have been working with OMRDD to minimize the impact on agencies in implementing the Food Stamp Offset. We would like to get feedback from providers on two issues. First, the financial impact on agencies using the established rate of $156 for supervised sites and $126 for supportive sites. The second is the logistical impact of retrieving food stamp cards from people who currently have possession of them. It will likely be a few months before OMRDD will be able to implement new regulations that mandate that Food Stamp Resource be turned over to the residential provider. · DELAY ON LIABILITY FOR SERVICES REGULATIONS EXTENDED

In February, OMRDD issued regulations related to liability of services for individuals who are not covered by Medicaid. Effective the same day, OMRDD promulgated emergency regulations which delay the effective date for specified services: MSC, Day Treatment, At Home Res Hab, Prevoc, Supported Employment, Respite, and Blended and Comprehensive Services. The regulations that delayed the effective date have expired. OMRDD issued a memo 5/14/09 announcing a temporary extension of the delay for an indefinite period of time. The new implementation date will be announced as soon as it has been determined. |

· FIRE SAFETY WEBCAST POSTPONED

The Fire Safety Webcast previously announced by OMRDD for May 18th or 19th is being postponed. |

· TREND LEGISLATION
|

TELL YOUR LEGISLATOR TO SUPPORT S. 4901 BY HUNTLEY AND A.7947 BY WEISENBERG This legislation requires the Commissioner of OMRDD to promulgate a 3% trend factor. Final approval is contingent on legislative action in a budget clean-up bill. More information will be available next week in a NYSACRA action alert. |

· MTA PAYROLL TAX
|
| |
The MTA bailout bill (S.5451/A.8180) was signed on May 7th by Governor Paterson as Chapter 25 of the Laws of 2009. This new law requires that every employer, within the 12 counties designated in the bill (The 5 NYC Boroughs, Nassau, Suffolk, Westchester, Rockland, Orange, Putnam & Dutchess), pay $0.34 for every $100.00 of payroll beginning March 1, 2009. The tax will be paid quarterly but the first payment shall be made:
"with the third quarterly payment due in tax year 2009; provided however, that the initial payment of such metropolitan commuter transportation mobility tax shall be made at the same time as the first payment of the withholding tax required to be paid pursuant to section 9 of the tax law that is due on or after October 31, 2009, and such payment by employers shall include the taxes owed for the entire period beginning on March 1, 2009 and that such payment by individuals with net earnings from self-employment shall include the estimated taxes owed for the 2009 tax year as limited by paragraph (ii) of subdivision (a) of this section, provided however, that public school districts within the MCTD shall include taxes owed for the period beginning September 1, 2009;"
Health or other benefits are NOT included in this calculation. |

NYSACRA, with the other associations, continues to advocate with the Legislature and the Governor's office for a trend or another mechanism to provide fiscal relief for our agencies. In order to advocate more effectively, we need an estimate of the cost of the MTA payroll tax on your agency.
