HHS RESCINDS MEDICAID REGULATIONS
|
| |
Three of the four Medicaid regulations that were previously issued,
then were on moratoria, and set to expire on July 1, have been
rescinded. The fourth will be delayed in enforcement until June 30,
2010. These changes were announced 6/29/09 by Secretary Sebelius of
the Department of Health and Human Services. The rescinded
regulations address: school-based administrative costs and
transportation; outpatient hospital and clinic services limited to
what Medicare would cover; and restricting beneficiary access to
case management services. "These regulations, if left in place,
would have potentially adverse consequences for Medicaid
beneficiaries, some of our nation's most vulnerable people," said
Secretary Sebelius. |

OMIG REGULATIONS

On June 24, 2009 the Office of the Medicaid Inspector General
adopted long awaited New York State Title 18 part 521 regulations
that will take effect on July 1, 2009. They mandate that providers
receiving more than $500,000 in Medicaid funding have a compliance
program. Previously, the threshold set by the 2006 Deficit Reduction
Act was $5 million in Medicaid dollars in any 12 month period. Click

SENATE DEBACLE CONTINUES
|
| |
Following nine Extraordinary Sessions, a few appearances in court
and almost a dozen different affidavits, the State Senate has yet to
act on legislation in a manner which is not without question. Senate
Democrats this week approved several pieces of legislation which
were set to expire at the end of June; Senate Republicans vowed to
challenge the bills and Governor Paterson publically stated his
refusal to sign them. The two factions continue to cite the need for
consensus on an operating agreement; both short term and long term
agreements have been drafted, but not accepted as of yet by either
side. While the Senate looks forward to "breaking" for the Fourth of
July holiday, the Governor may continue to call Extraordinary
Sessions throughout the weekend. |

PANEL OF FIRE SAFETY EXPERTS TO CONVENE
|
| |
OMRDD has formed a panel of statewide and national experts to
provide recommendations to the Commissioner on topics of site
selection, individual need-based fire safety features, preparing
clear evacuation plans, conducting effective fire drills, best
practices for testing fire safety equipment; and best practices for
staff training. Convening in July, the panel will address current
policies, procedures and practices in the areas of fire safety for
thoroughness and effectiveness, and will propose recommendations for
system-wide changes. There will be representation from the
not-for-profit provider community on the panel. |

SELF ADVOCACY ASSOCIATION ANNUAL CONFERENCE
|

"From Me to We," is the theme for this year's Statewide Conference,
to be held September 10, 11 and 12 at the Albany Marriott Hotel.
David Liscomb, President of the Self-Advocacy Association of New
York State said, "Our annual conference is the largest self-advocacy
event in the country and we couldn't do it without the help of
provider organizations who support self-advocates to attend. Thank
