· NEEDED: DIRECT SUPPORT PROFESSIONAL PROFILES FOR LEGISLATIVE SEASON

As we've done for the previous nine years, NYSACRA will again provide our New York State legislators with "profiles" that provide information about our 65,000 Direct Support Professionals and the important work that they do assisting people with intellectual and other developmental disabilities every day. That means we need your photographs and brief stories about a direct support professional; this year, the focus is on relationship(s). We invite your stories about how our direct support professionals help people in their homes, live healthy lives, build trusting relationships and contribute to their communities. As in previous years, we will deliver these "profiles" about the kinds of support we provide to our legislators on a weekly basis. Start thinking about your stories now. · NEW ADM ON JONATHAN'S LAW APPEALS & REVISED INCIDENT BROCHURE

OMRDD has released a new Administrative Memorandum (#2009-04) which sets forth the process to be followed when an agency denies a request for access to records made under Sections 624.6 and 624.8. Final regulations have been adopted that revise Part 624 to implement the notification and release of records requirements of Chapter 24 of the Laws of 2007 (Jonathan's Law). The two new provisions provide for an administrative appeal when records requests are denied by the agency. OMR also issued an updated version of their brochure, Learning About Incidents, available in both English and Spanish. |

· CORPORATE COMPLIANCE SURVEY
|

A few of our sister associations have developed a survey to collect information about the costs of corporate compliance programs, in order to better advocate for improvements. The goal is to collect just one survey from every organization, by January 4, 2010, Using financial information drawn from Consolidated Fiscal Reports, it will compare 2005 with 2008. The information will be encrypted to protect the data, and not used or released for any other purposes. The cover letter includes a live link to Survey Monkey where you will find the document. The letter also provides more detail about the survey, as well as who to contact with questions. |

· LIABILITY FOR SERVICES CLARIFICATION
|

In the 12/9/09 News and Views, we reported that the amended Liability for Services regulations are to be effective March 15, 2010. (They will add Medicaid Service Coordination; Day Treatment Services; At Home Residential Habilitation Services, Prevocational Services, Supported Employment Services, Respite Services; and Blended and Comprehensive Services (OPTS Services) to the covered services.) Here's where we need to clarify a point: There is an exception for individuals who receive only Supported Employment OR respites services but no other covered services. We need to clarify that the exception will not apply if an individual has been in receipt of full Medicaid coverage and enrolled in the HCBS Waiver on or after the implementation date of the regulations. The intent is to make it clear that someone in respite only or in supported employment only cannot drop out of Full Medicaid and HCBS waiver enrollment in order to exempt themselves from liability for services. |

Registration for these programs is FREE, but for nurses only. However, interested professionals, individuals and family members may sit in on any of the class sessions. This training is made available by the Developmental Disabilities Planning Council and the Rehabilitation Research and Training Institute, through a grant from the Health Resources & Services Administration (HRSA). |
